Property Maintenance Disclaimer

Access to Work Areas:
The Customer agrees to provide safe and unobstructed access to all areas scheduled for maintenance. Vehicles, trailers, dumpsters, equipment, outdoor furniture, and any other personal or business property that may interfere with the performance of the work shall be relocated by the Customer prior to the scheduled service.

Vehicles in Parking Areas:
The Customer is responsible for ensuring that all vehicles are removed from or relocated within designated work areas before maintenance begins. The Contractor shall not be responsible for incomplete services, skipped areas, or reduced quality of work resulting from vehicles or other obstructions that prevent access.

To the fullest extent permitted by New Jersey law, the Contractor shall not be liable for damage to vehicles or personal property that remain within active work areas after work has commenced, including but not limited to incidental contact with grass clippings, mulch, dust, dirt, stones, sticks, leaves, water, debris, or other materials normally associated with landscape and property maintenance operations.

The Contractor will exercise reasonable care during the performance of its work but assumes no responsibility for damage resulting from vehicles or personal property left in designated work areas after reasonable access has been provided.

Hidden Conditions:
The Contractor is not responsible for damage to underground utilities, irrigation components, invisible pet fencing, landscape lighting, septic systems, drainage systems, private wiring, or other concealed improvements that are not clearly marked or disclosed by the Customer prior to the commencement of work.

Delays Beyond Contractor's Control:
Service schedules may be adjusted due to weather conditions, equipment breakdowns, emergencies, governmental restrictions, or other circumstances beyond the Contractor's reasonable control. Such delays shall not constitute a breach of this Agreement.

Property Conditions:
The Contractor is not responsible for damage resulting from pre-existing site conditions, deteriorated pavement, loose curbing, unstable edging, improperly installed irrigation components, dead or hazardous trees, hidden objects, or any condition not reasonably visible prior to commencing work.

Indemnification:
To the fullest extent permitted by New Jersey law, the Customer agrees to defend, indemnify, and hold harmless the Contractor, its owners, employees, and subcontractors from claims, damages, or expenses arising from the Customer's failure to remove vehicles, equipment, or other property from designated work areas, except to the extent caused by the Contractor's gross negligence or willful misconduct.

Acceptance:
Acceptance of any proposal and scheduling of services constitutes acknowledgment and acceptance of these Terms and Conditions.
